Probate proceeding conducted in a state other than the state where the decedent lived and the primary probate occurred is ancillary probate. This occurs when the probate takes place in a different state than where the deceased resided. For example, the additional probate required to legally transfer title when the oil royalties are not located in the same state as the decedent.
