Express trust is a trust created with the settlor’s express intent. Express trust arises out of a direct or positive declaration of trust. It comes into existence by the execution of an intention to create it by the person having legal and equitable dominion over the property made subject to it. Express trust is usually declared in writing, although they can be oral.
