Posting Bond by Trustees

In Mississippi, the Chancery Court may require that a tustee (such as trustee of a trust created in a Will) post bond or not make the requirement of bond even if the trust provides that bond should be required.  In making a determination, the Court will consider the best interest of the Beneficiaries.

The court specifies the amount of a bond, its liabilities, and whether sureties are necessary. The court may modify or terminate a bond at any time.
