If small estate laws apply there is no need to probate or open an administration to collect property of the estate. Instead, an affidavit containing the requirements of law may be signed provided the value of the entire probate estate of the decedent, wherever located, excluding all liens and encumbrances thereon, does not exceed Seventy-five Thousand Dollars ($75,000.00).
