What is the difference between a Will and a Living Will?

A Will or Last Will and Testament is what you make to show who you want to receive your property and estate. It can cover all property that will pass through your Estate. It does not include property that passes outside your estate such as real estate held as joint tenants with rights of survivorship. That property passes to the survivor.

A Living Will is not a Will at all. It is a document that expresses what you want to happen if you end up on life support and are not likely to recover, as well as other serious medical conditions. In some States it is called a Health Care Directive or other name.
